During the course of his career, Mr. Graham has achieved multiple defense verdicts on claims exceeding several millions of dollars, been successful in summary judgment practice on claims in excess of a million dollars, and successfully negotiated the resolution of claims involving catastrophic losses and business exposure in the $10,000,000 million dollar range.  In one recent case, after a two week Federal court trial, he successfully defended and defeated a multiple million dollar maritime products liability action and convinced the court to award his client attorney's fees as the prevailing party utilizing novel arguments in support of this extraordinary relief.

  • Civil Action No. H-00-0157; Condux S.A. de C.V. v. Ships Machinery International, Inc.; In the United States District Court for the Southern District of Texas, Houston Division. Achieved Complete Defense Verdict after two week bench trial before Federal District Judge Harmon.  Case involved maritime products liability claims and breach of contract claims.  Presented novel arguments to receive both a defense verdict and award of attorney's fees.
  • Cause No. 02-2247; Piazza d'Italia Hotel Associates, LLC and Darryl Berger Companies, Inc. v. Starwood Hotels and Resorts Worldwide, Inc.; In the United States District Court for the Eastern District of Louisiana. Second chair responsibility in defense of major noted developer sued on breach of development contract.  Took majority of fact witness depositions and presented briefing to the court.  After a two week trial, we received a defense verdict on plaintiff's 20+ million dollar damage claims.
  • AAA Matter No. 70 198 00681 02; Modec International, LLC v. Delta Engineering Corporation. Successfully defended maritime contractor in construction litigation seeking in excess of 2M damage award.
