Justin B. Whitley maintains a broad and diverse litigation practice. He has extensive experience in all stages of litigation, including pre-trial investigation, discovery, motion practice, dispute resolution (including mediation and arbitration), trial, and appeal.  He has handled civil litigation matters in state and federal court relating to commercial defense, contractual disputes, consumer litigation including Deceptive Trade Practices Act violations, business torts, real estate disputes, construction disputes, premises liability, products liability, personal injury, toxic torts, fraud, negligence, sworn accounts, condemnation proceedings, and employment discrimination. 

Mr. Whitley’s experience includes litigation in the oil and gas industry, including litigation of exploration, production and marketing disputes, as well as litigation of disputes over drainage, royalties, surface use, pooling and unitization, operating agreements, environmental contamination, operator removal, trade secrets, surface damages, preferential rights, surface easements, breaches of implied covenants to develop and market, and lease terminations.
