Russell Owens’ practice focuses on resolution of a broad range of business disputes, and involves negotiation, mediation and arbitration as well as trial representation. Mr. Owens has significant trial experience as solo or first-chair counsel in state and federal courts. He enjoys a successful appellate practice, including having argued and won appeal to the Georgia Supreme Court.
Mr. Owens handles a variety of construction-related matters, including contract drafting, negotiation and disputes, intellectual property and defect claims. He represents owners, contractors, subcontractors and architects.
He also represents clients in intellectual property and entertainment matters, including copyright and trademark interests in architectural, musical, and digital works. He has represented artists in negotiation of recording and publishing contracts, including works on major label albums.
Significant Cases
- In multi-million dollar case affecting liability standard for all insurance agents, won summary judgment at trial level, which Court of Appeals reversed. Appealed to Supreme Court and argued the case before all Justices. Obtained unanimous decision in client’s favor, reversing Court of Appeals decision and limiting liability of client
- In professional liability matter with over $46 million in claimed damages, held primary responsibility for defense of all phases; complex matter resolved favorably after jury selection
- Argued and won unanimous decision on appeal to Georgia Supreme Court on standard of liability for all insurance agents
- Won Real Estate Contract and Payment Dispute on Summary Judgment. December 4, 2007
- Won Summary Judgment on Copyright Infringement Claims regarding Use of Architectural Plans. May 14, 2007
- Won Defense Verdict and Fees in AAA arbitration, representing Owner/Developer against Claims by Contractor and Subcontractor for Delay Damages and Extra Work. November 6, 2006
