In an article published in the Winter/Spring edition of Energy Executive, Annette Idalski discusses the Gate Guard case, in which the Texas Federal District Court found workers for Gate Guard were independent contractors - and not employees - of the firm. According to Annette, the case is a strong precedent because not only did the Texas Federal District Court find that these workers were independent contractors, but the Texas Federal District Court and the Fifth Circuit Court of Appeals awarded Gate Guard attorneys’ fees for having to litigate for a long period of time.
