Covid-19 Credit Deadline Crunch Pushes Businesses to Risky Suits

Chamberlain Hrdlicka shareholder Tom Cullinan was recently featured in Bloomberg Law, where he discussed the evolving landscape of Employee Retention Credit (ERC) litigation as businesses face looming deadlines to challenge denied or delayed tax credit claims.

In the article, "Covid-19 Credit Deadline Crunch Pushes Businesses to Risky Suits," Cullinan explained that many taxpayers initially delayed filing lawsuits because they were hesitant to become the first to test unsettled legal issues in court. As a result, substantive ERC cases have only recently begun shaping the legal standards that will govern future claims.

Cullinan noted that as the statute of limitations approaches, more businesses are choosing to litigate despite the costs and uncertainty involved.
