In an article published in New Jersey Society of Certified Public Accounts Focus Blog on January 8, S.A.L.T. Practice Co-Chair Jennifer Karpchuk discusses that although the text of Public Law 86-272 has remained unchanged since it was enacted 60 years ago, the attacks on the federal law by states has increased in recent years.

“Because Public Law 86-272 shields a company from income tax liability in a state, states (and state organizations) have a desire to interpret the federal law as narrowly as possible,” writes Karpchuk.

She specifically explains the state actions in accordance with the MTC’s guidance and the challenges that states are and will continue to face in adopting this revised interpretation.
