In an article published by Law360 on March 16, 2016, Gregg M. Jacobson provided his opinion on President Obama’s recent nomination of D.C. Circuit Chief Judge Merrick B. Garland. Jacobson expressed that the “Republican Party will not allow hearings or a vote on President Obama’s nominee. They said so soon after Justice Scalia’s passing, said the same even when Republican Governor Brian Sandoval was a potential nominee, and reiterated that position today.” He went on to say that “Judge Garland’s record on gun rights could be enough to deny him a confirmation hearing in an ordinary year.
