In an article published in the November issue of Thomson Reuters Estate Planning Journal and the December issue of Thomson Reuters Journal of International Taxation, Scot Kirkpatrick and Stephen Heymann provide insight into role of the “Marquis Fiduciary” including considerations and guidance for the prospective fiduciary. The article details specific strategies an ambitious fiduciary should examine to go beyond the minimum requirements of the role.

The attorneys state, “Any prospective executor or trustee should carefully consider whether to accept or decline to serve as a fiduciary. Should an individual desire to accept service, it is important that they fully understand the provisions of the relevant will or trust and the associated duties and obligations associated with those roles. Of course, abiding by fiduciary duties should be considered the bare minimum…and fiduciaries should always search for opportunities to go above and beyond.”
