In an article published in Law360 on July 22, 2022, Philadelphia-based Chamberlain Hrdlicka Shareholder Jennifer Karpchuk provided insight on Apple’s settlement with Chicago over the city’s tax on its streaming services. According to the article, this settlement “leaves unanswered questions about the tax's scope that observers hoped would be addressed by the court's breaking new ground in ruling on federal tax limitations on electronic commerce.”

"It's unfortunate," explains Karpchuk, "because [the case] could have clarified a little bit of what was missing in Labell."

Although the Apple litigation, which originated in 2018 and was put on hold until Labell was decided, centered on Chicago's tax, Karpchuk said that other local governments could look to the outcome of those lawsuits as justification to impose similar taxes.
